We believe games and digital experiences should bring people together, inspire creativity, and make life a little more fun.
These Terms of Service ("Terms") govern your use of the games, applications, websites, and digital services developed, published, or operated by Moonpickle Studios Inc. ("Moonpickle," "we," "our," or "us").
By accessing or using our Services, you agree to these Terms. If you do not agree, you should not use the Services.
If you are a parent or legal guardian providing access to a child through a parent-managed account, you agree to these Terms on behalf of yourself and, to the extent permitted by law, the child.
Nothing in these Terms limits your rights under applicable consumer protection, privacy, or other laws.
1. Our Services
These Terms apply to the Moonpickle Studios family of products and services, including:
Moonpickle Studios Website and Browser Games
Our website, free-to-play browser games, interactive experiences, and related online features.
MyNiftyGifty
Our family gift registry and wish-sharing application, including wish lists, family circles, parent-managed child profiles, and related features.
BIG2 Games
Our tabletop and card-game scorekeeping platform, including game sessions, player histories, statistics, and leaderboards where available.
Brine Alert
Our upcoming commercial video game planned for distribution through Steam, including its gameplay, leaderboards, and online features when released.
Future Moonpickle Products
Additional games, applications, and digital experiences that expressly adopt these Terms.
These products are collectively referred to as the "Services."
Specific games or applications may have additional rules, end-user license agreements, privacy notices, or other product-specific terms ("Supplemental Terms").
If Supplemental Terms conflict with these Terms, the Supplemental Terms apply to the relevant product or feature, subject to applicable law.
Features described as upcoming or planned are not promised or guaranteed to become available.
2. Eligibility, Parents, and Children
Some Moonpickle products are intended for general audiences, while others are designed for family use or may have age restrictions.
You must be legally eligible to use the applicable Service and comply with any minimum age requirements.
2.1 Parent-managed child profiles
MyNiftyGifty provides family-oriented features in which children participate through profiles created, authorized, or managed by a parent or legal guardian.
Children do not independently administer these parent accounts.
The parent or guardian is responsible for managing access, choosing appropriate family-circle participants, and using the available privacy and supervision controls.
Moonpickle is responsible for implementing appropriate protections for children's personal information and complying with applicable privacy laws.
Parental supervision does not relieve Moonpickle of its own legal responsibilities.
2.2 General games and online services
Children and minors may access age-appropriate free games where permitted by applicable law and any parental-consent requirements.
Individual games may have age ratings, content warnings, or restrictions that determine whether they are appropriate for a particular audience.
2.3 Steam games
Games distributed through Steam are subject to Steam's account eligibility requirements, applicable game ratings, and parental supervision requirements.
Moonpickle does not override Steam's account or age restrictions.
3. User Accounts
Some Services may require an account, while others, including certain browser games, may be accessible without registration.
When creating or maintaining an account, you agree to:
- Provide accurate account information where required.
- Protect your account credentials.
- Avoid impersonating other individuals.
- Respect the account's intended access restrictions.
- Notify us of suspected unauthorized use.
You may not sell or transfer a personal account without authorization.
Family access and child profiles managed through supported parental features are not prohibited by this restriction.
Account access may be suspended or restricted when necessary for security, fraud prevention, violations of these Terms, or legal compliance.
4. Free Browser Games
Moonpickle Studios provides games and interactive experiences that can be played free of charge through its website.
Unless expressly indicated otherwise, these browser games do not require a purchase.
4.1 Personal entertainment
Our free games are provided for personal, lawful entertainment.
You may not reproduce, redistribute, commercially exploit, or modify protected game software without permission or another applicable legal right.
4.2 Game performance
Browser games may depend on internet connectivity, browser compatibility, device performance, and available server infrastructure.
We cannot guarantee that every game will function identically across all devices or browsers.
4.3 Progress and scores
Where browser games offer scores, saved progress, achievements, or leaderboards, we may implement reasonable technical limitations, security measures, and maintenance procedures.
Unless a specific feature promises otherwise, game progress and scores are not guaranteed to remain available indefinitely.
Internet access or mobile data charges imposed by your provider are your responsibility.
5. MyNiftyGifty — Family Gift Sharing
MyNiftyGifty enables families and friends to organize, manage, and share gift ideas and wish lists.
5.1 Family circles
Users may create family circles, invite participants, share wish lists, and organize gift-related information.
You are responsible for choosing who receives invitations and access to information you share.
Information shared within a family circle may be visible to other authorized members of that circle.
5.2 Parent-managed children's profiles
Children's participation is administered through a parent or legal guardian's account.
Parents and guardians may manage their children's profiles and associated information using available application controls.
Where supported, parents may request access to, correction of, or deletion of their children's personal information, subject to applicable legal requirements.
Moonpickle will use age-appropriate privacy protections and provide relevant information about how children's data is handled.
5.3 Wish lists and shared content
Users may upload or enter gift ideas, product descriptions, images, preferences, and other wish-list content.
Users must have the necessary rights or permissions to share that content.
We recommend avoiding unnecessary sensitive personal information, especially in child profiles and shareable lists.
5.4 Third-party products
Gift lists may contain references or links to products sold by independent retailers.
Moonpickle does not become the seller of those products merely because they appear on a wish list.
Any purchases made directly with third-party retailers are governed by the relevant retailer's terms and policies.
5.5 No in-app purchasing
MyNiftyGifty does not currently offer in-app purchases or in-app payment transactions.
Creating wish lists, viewing gifts, or sharing gift ideas does not constitute a purchase through Moonpickle.
If commercial transaction features are introduced in the future, the applicable pricing, purchase conditions, and any Supplemental Terms will be disclosed before users are asked to use them.
6. BIG2 Games — Scorekeeping and Leaderboards
BIG2 Games provides digital tools for recording, organizing, and reviewing tabletop and card-game results.
The platform may preserve game histories, player records, statistics, rankings, and achievements where supported.
6.1 Game results
Game organizers and participants are responsible for entering accurate scores and results.
Moonpickle does not independently referee every game or guarantee that user-entered results are accurate.
6.2 Persistent records
BIG2 is designed to preserve game history and enable players to review previous games, statistics, and rankings.
Although persistence is a platform objective, uninterrupted storage or permanent preservation of every record cannot be guaranteed.
Data retention and deletion remain subject to the Privacy Policy and applicable law.
6.3 Fair play and rankings
Users must not intentionally falsify scores, manipulate rankings, exploit technical vulnerabilities, or interfere with the records of other players.
Moonpickle may correct or remove fraudulent or technically invalid results where reasonably necessary.
6.4 Independent tabletop games
BIG2 may provide scorekeeping formats compatible with independently published tabletop and card games.
References to third-party game names or trademarks do not imply affiliation, sponsorship, or endorsement.
Intellectual property associated with those games remains with its respective owners.
6.5 No current in-game rewards
BIG2 Games does not currently provide cryptocurrency rewards, cash prizes, or other financial rewards for gameplay.
Recording a win, achieving a ranking, or participating in a game does not entitle a user to cryptocurrency or financial compensation.
Any separately existing BIG2 blockchain token is distinct from the current gameplay and scoring features.
If a game reward or digital-asset integration is introduced in the future, it will be subject to separately published terms, eligibility requirements, and applicable laws before launch.
7. Brine Alert — Steam Game
Brine Alert is a Moonpickle Studios game planned for commercial distribution through Valve's Steam platform.
The following provisions apply when the game is released and to the extent that its described features are offered.
7.1 Purchasing Brine Alert
Brine Alert is intended to be a paid game distributed through Steam.
Purchases made on Steam are processed through Steam and are subject to the applicable Steam Subscriber Agreement, purchasing conditions, and refund policies.
Moonpickle does not independently control Steam's checkout, payment processing, or account billing systems.
7.2 Game license
Purchasing access to Brine Alert does not transfer ownership of the game's source code, artwork, characters, music, or other intellectual property.
Access to the software is licensed under the applicable Steam terms and any game-specific end-user license agreement presented to the player.
These Moonpickle Terms govern applicable game conduct and Moonpickle-operated features without replacing the Steam Subscriber Agreement.
7.3 Refunds
Refund requests for purchases made through Steam should be submitted through Steam's official refund process.
Refund eligibility is determined under Steam's applicable refund policy and mandatory consumer-protection laws.
Nothing in these Terms limits your legally protected refund rights.
7.4 Leaderboards and competitive integrity
Brine Alert may include local or online leaderboards, player rankings, scores, records, and other competitive features.
Players agree not to:
- Deliberately falsify scores or rankings.
- Use unauthorized cheats, bots, or automated gameplay systems to manipulate competitive results.
- Exploit vulnerabilities to obtain unfair leaderboard positions.
- Impersonate other players or manipulate their records.
- Interfere with game servers or competitive systems.
Moonpickle may investigate suspicious results and correct, invalidate, or remove scores that reasonably appear to have been manipulated.
Where appropriate, users may be provided an opportunity to challenge an enforcement decision.
7.5 Player identities and leaderboard visibility
Where online leaderboards are enabled, player identifiers, display names, scores, rankings, and related game statistics may be visible to other players.
If Steamworks leaderboard services are used, applicable information may be processed or displayed through Steam in accordance with Steam's terms and privacy practices.
Additional details concerning personal data, game telemetry, and any security or anti-cheat technologies will be provided through the applicable Privacy Policy and game-specific notices.
7.6 Updates and online availability
Brine Alert may receive updates, bug fixes, balance adjustments, and feature improvements.
Certain online functionality may require an internet connection or integration with Steam services.
Moonpickle may modify online features for technical, security, operational, or legal reasons.
Any material changes affecting purchased content remain subject to applicable consumer rights and contractual obligations.
7.7 Steam accounts and enforcement
Suspension from a Moonpickle-operated leaderboard or online feature does not automatically terminate ownership of or access rights to a Steam purchase.
Steam account restrictions and access to Steam itself are governed by Valve's applicable policies.
Moonpickle may restrict game-specific online functionality where justified by these Terms, subject to applicable law.
8. Community Conduct
We want the Moonpickle Universe to be welcoming, creative, and enjoyable.
Users must not:
- Harass, bully, threaten, or abuse other users.
- Publish hateful, exploitative, or unlawful material.
- Sexually exploit or endanger minors.
- Share another person's private information without authorization.
- Engage in scams, fraud, impersonation, or phishing.
- Distribute malicious software.
- Interfere with application or game infrastructure.
- Manipulate rankings, scores, or online competitions.
- Use Services for unlawful gambling or unauthorized wagering.
- Violate another person's intellectual property rights.
We may investigate reported misconduct and take proportionate action, including content removal, score correction, account restrictions, or suspension of online access.
Serious safety or security issues may require immediate action.
9. User-Generated Content
Some Services allow users to submit photographs, wish lists, descriptions, scores, usernames, game records, comments, and other information ("User Content").
You retain the rights you hold in your User Content.
By submitting User Content, you grant Moonpickle a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, and technically adapt that content as reasonably necessary to operate, maintain, secure, and improve the applicable Services.
This includes displaying content to other users according to the sharing features and permissions you select.
Moonpickle does not obtain ownership of your User Content.
You confirm that you have the necessary rights and permissions to submit the content.
We may remove User Content that infringes rights, violates these Terms, or presents a legitimate legal or safety concern.
Deleted content may remain temporarily in backups or records retained for legitimate legal purposes. Information already shared with or copied by other users may not be fully retrievable.
User Content submitted directly through Steam features may also be subject to Steam's applicable terms.
10. Intellectual Property
Moonpickle Studios Inc. owns or licenses the intellectual property associated with its original products and Services, including applicable:
- Software and game code.
- Original game characters and designs.
- Artwork, graphics, animations, and music.
- Studio and product logos.
- Trademarks and branding.
- Game interfaces and original content.
- Documentation and promotional materials.
These rights are protected by applicable intellectual property laws.
Except as expressly permitted, you may not reproduce, redistribute, sell, or commercially exploit Moonpickle's protected materials without authorization.
These restrictions do not override rights available under applicable law, separate licenses, or permissions granted by third-party rights holders.
References to independently published games, services, or trademarks do not imply that Moonpickle owns those properties.
11. Software Licenses and Restrictions
Moonpickle grants users a limited, non-exclusive, non-transferable license to access and use applicable free Services for lawful, personal purposes.
Paid software distributed through Steam is additionally governed by the applicable Steam license and any product-specific agreement.
Users must not circumvent technical access controls, commercially redistribute protected software without authorization, or deliberately disrupt the Services.
Nothing in these Terms restricts lawful interoperability, reverse engineering, security research, or other rights that cannot legally be excluded.
12. Third-Party Platforms and Services
Our Services may use or integrate with independent providers, including:
- Steam and Steamworks.
- Application distribution platforms.
- Authentication and hosting providers.
- Third-party merchants and product websites.
- Other technologies necessary to operate our Services.
Those providers may have separate legal agreements and privacy practices.
Moonpickle is responsible for its own Services and legal obligations but does not control independently operated platforms.
Your use of third-party services may be governed by additional terms established by those providers.
13. Privacy and Personal Information
Moonpickle handles personal information in accordance with its Privacy Policy and applicable privacy laws.

Information processed by our Services may include account details, user-submitted content, family-circle information, game records, technical identifiers, and related usage data, depending on the Service and features used.
The Privacy Policy will describe what information is actually collected, the purposes for collecting it, how it is protected, and applicable retention and deletion practices.
Children's privacy
Children's information, including information held in MyNiftyGifty's parent-managed profiles, requires particular care.
Where applicable, Moonpickle will obtain appropriate parental authorization, provide suitable privacy information, and apply safeguards to protect children's personal information.
Information about children will not be made publicly accessible merely because they participate in a family account.
The Privacy Policy and any Children's Privacy Notice will explain parental rights and available privacy controls.
Acceptance of these Terms does not replace any separate consent required by law.

14. Game Updates, Maintenance, and Availability
Moonpickle may update applications, fix defects, introduce new features, or make reasonable operational changes.
Services may occasionally be unavailable due to maintenance, network outages, hosting interruptions, or circumstances beyond our reasonable control.
We strive to maintain reliable experiences but do not guarantee uninterrupted access.
We may discontinue free games or optional online features where reasonably necessary.
For paid products, changes and discontinuation remain subject to any contractual commitments and applicable consumer-protection laws.
15. Feedback and Suggestions
We welcome feedback, bug reports, improvement ideas, and suggestions from our community.
By voluntarily submitting feedback, you permit Moonpickle to consider and use that feedback to develop or improve its products without compensation, unless otherwise agreed in writing.
This permission does not transfer ownership of unrelated copyrighted materials or override privacy rights.
16. Account Suspension and Termination
Users may stop accessing our Services at any time.
Where account functionality exists, users may request account deletion through the available application controls or by contacting support@moonpicklestudios.com.
Moonpickle may restrict or suspend accounts or online features for material violations of these Terms, fraud, serious misconduct, security threats, or legal compliance.
Where reasonably appropriate, we may provide notice and an opportunity to address the issue.
Termination of a Moonpickle website or application account does not itself revoke a separately purchased Steam license.
Account deletion and the handling of associated personal information remain subject to applicable privacy law and the Privacy Policy.
17. Disclaimers
Moonpickle strives to provide reliable and enjoyable games and applications.
However, to the extent permitted by law, our Services are provided on an "as available" basis.
We do not guarantee:
- Uninterrupted online availability.
- Error-free software operation.
- Compatibility with every device or operating system.
- Permanent retention of every game score or record.
- Accuracy of user-submitted information.
- Continued availability of independent third-party services.
Nothing in these Terms excludes applicable statutory warranties or mandatory consumer protections.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Moonpickle is not responsible for indirect, incidental, special, or consequential damages arising from the use or inability to use its Services where such liability can lawfully be excluded.
For claims subject to a legally enforceable contractual liability cap, Moonpickle's total aggregate liability will not exceed the greater of:
(a) the amount paid by the user for the applicable Moonpickle product or Service during the preceding twelve months; or
(b) CAD $100.
These limits do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, intentional wrongdoing, or other legally non-excludable obligations.
Nothing in this section reduces mandatory consumer rights or statutory remedies.
19. Indemnification
To the extent permitted by law, users agree to reimburse Moonpickle for reasonable losses arising directly from their unlawful conduct, intentional misuse of the Services, or infringement of third-party rights.
This obligation does not apply to losses caused by Moonpickle's own wrongful acts or failures to meet its legal obligations.
20. Changes to These Terms
We may revise these Terms as our games, applications, and Services evolve.
Material changes will be communicated through appropriate channels where required or reasonably practicable.
Updated Terms will display a revised effective date.
Where applicable law requires affirmative acceptance, we will obtain it before the revised provisions become binding.
Continued use of affected Services after a valid update may indicate acceptance where legally permitted.
Users who do not agree may discontinue use and exercise any applicable cancellation or statutory rights.
21. Governing Law and Disputes
These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, except where mandatory laws require otherwise.
We encourage users to contact Moonpickle regarding disputes before initiating formal proceedings.

Both parties may attempt informal resolution in good faith.
Subject to applicable consumer-protection and jurisdictional rules, disputes may be submitted to a court of competent jurisdiction in Alberta, Canada.
Nothing in these Terms prevents users from exercising mandatory rights or remedies available in their place of residence.
22. General Provisions
Entire Agreement
These Terms, together with applicable Supplemental Terms, govern the relevant Moonpickle Services unless a separate agreement expressly provides otherwise.
Severability
If a provision is determined to be unenforceable, the remaining provisions remain effective to the extent permitted by law.
No Waiver
Failure to enforce a provision does not constitute a permanent waiver of that provision.
Assignment
Moonpickle may transfer these Terms as part of a legitimate corporate reorganization, merger, or sale, subject to applicable law.
Survival
Provisions relating to intellectual property, liability, disputes, and accrued obligations may survive termination where appropriate.
Language
Translations may be made available for convenience. Applicable language rights and legal requirements will be respected.
